Overview

The General Product Safety Regulation (GPSR, Regulation (EU) 2023/988) has applied since December 13, 2024, to all consumer products in the EU — including clothing and textiles on Amazon.es. In Spain, enforcement is carried out by the Ministerio de Consumo at the national level and the Direcciones Generales de Consumo of the Comunidades Autonomas at the regional level. Inspectores de consumo conduct market surveillance checks and can have textiles tested for REACH-restricted substances. For clothing sellers on Amazon.es, this means: obligation to designate an EU Responsible Person (Persona responsable), risk assessment, Spanish-language labeling (etiquetado) per Real Decreto 928/1987, textile labeling under EU Regulation 1007/2011 with fiber composition (composicion de fibras) in Spanish, and full traceability (trazabilidad). Spain currently has no textile-specific EPR system (unlike France with Refashion), but GPSR requirements apply in full.

This checklist applies to all manufacturers, importers, and distributors selling clothing and fashion products on Amazon.es. This includes: outerwear (chaquetas, pantalones, camisas, vestidos), underwear and nightwear (ropa interior, pijamas), sportswear (ropa deportiva), children's clothing (ropa infantil), scarves, hats, gloves, socks, and textile accessories (cinturones, bolsos de tela). Special attention is required for children's clothing (strangulation risk from cords per EN 14682, swallowable small parts), nightwear (flammability), and fast fashion items (price-sensitive market with high volume — low-quality products are more frequently challenged during inspections). The Guardia Civil and the Policia Nacional also actively pursue counterfeits (falsificaciones).

Determine Economic Operator Role and Designate EU Responsible Person

The GPSR defines different obligations for manufacturers (fabricante), importers (importador), and distributors (distribuidor). For non-EU companies, a responsible person in the EU (Persona responsable) is mandatory who can cooperate with Spanish authorities (Ministerio de Consumo, Comunidades Autonomas).

Conduct Risk Assessment and Safety Evaluation

The GPSR requires an internal risk analysis (analisis de riesgos) for every product. For clothing, mechanical risks (cords, small parts), chemical risks (REACH Annex XVII — azo dyes, formaldehyde, nickel, phthalates), and flammability must be assessed. The GPSR tightens labeling requirements: every product must be uniquely identifiable and carry contact details of a responsible economic operator. Ensure Traceability and Technical Documentation

The GPSR strengthens traceability (trazabilidad) requirements. Every product must be uniquely identifiable and the supply chain must be fully documented. Amazon actively enforces the GPSR on Amazon.es and requires sellers to provide specific data in Seller Central. Missing GPSR attributes risk listing suspension. Amazon.es increasingly also checks textile composition information in listings.

Common Mistakes to Avoid

No EU responsible person (Persona responsable) indicated on the label or in Seller Central

Consequence: Amazon suspends listings without EU Responsible Person. The Ministerio de Consumo and Comunidades Autonomas can impose fines and prohibit distribution in Spain. In the worst case, goods may be seized by the Agencia Tributaria upon import.

Prevention: Ensure name, postal address, and email of a responsible person based in the EU appears on every label or packaging — and is simultaneously entered in the GPSR fields in Amazon Seller Central.

Fiber composition missing or not in Spanish language

Consequence: Violation of EU Regulation 1007/2011 and Real Decreto 928/1987. Fines by the Comunidades Autonomas (up to EUR 30,000 for serious violations). Amazon.es can suspend listings. Spanish consumers frequently report missing or incomprehensible textile labeling via the Hojas de Reclamaciones (official complaint forms).

Prevention: Always provide fiber composition in Spanish (algodon, poliester, lana, seda etc.) with percentages in descending order. Multilingual labels are permissible, but Spanish must be included.

Cords and drawstrings in children's clothing not checked per EN 14682

Consequence: Strangulation risk for children. Safety Gate notification (formerly RAPEX), immediate recall (retirada del mercado), reputational damage, and potential criminal consequences in Spain. Children's clothing with cords is the most common cause of Safety Gate notifications in the textile sector.

Prevention: Check every children's garment for cords, drawstrings, and functional cords per EN 14682. For children under 7, cords in the head/neck area are completely prohibited. For children 7-14, length restrictions apply. If in doubt, have testing performed by AITEX or another accredited laboratory.

No risk analysis conducted because clothing is considered a 'low-risk product'

Consequence: The GPSR requires a risk analysis for ALL consumer products — including clothing. During inspections by Inspectores de Consumo, missing risk analysis can trigger immediate measures: sales ban, forced recall, and fines. The burden of proof lies with the economic operator.

Prevention: Document a risk analysis for each product group. For clothing at minimum: mechanical risks (cords, small parts), chemical risks (dyes, coatings, metal parts per REACH), flammability, and special risks for children's clothing.

GPSR fields in Amazon Seller Central not filled or incomplete

Consequence: Amazon suspends listings with missing GPSR attributes — often automated and without warning. Reactivation can take days to weeks. Particularly affected: clothing ASINs without registered manufacturer details and EU Responsible Person.

Prevention: Proactively fill in the GPSR mandatory fields in Amazon Seller Central for all ASINs: manufacturer name and address, EU Responsible Person, email, warnings. For many ASINs, use the GPSR flat file template for batch upload.

Q1Does clothing need CE marking for the Spanish market?

No. Clothing and textiles do not require CE marking as they do not fall under a CE-mandatory EU directive.
