Product liability obliges manufacturers, importers, and sometimes distributors to pay damages when a defective product causes injury or property damage, regardless of fault (strict liability).
Why it matters
For Amazon sellers, product liability can be existentially threatening. The modernised Directive (EU 2024/2853) now covers digital products and AI systems. Product liability insurance is strongly recommended.
What you need to do
Complete conformity assessment and documentation, product liability insurance, defined recall process, retention of all test reports for at least 10 years.
