Definition
Under EU product law, the manufacturer is the person or company that manufactures or has a product manufactured and markets it under their own name or brand, bearing primary responsibility for safety.
Why it matters
Private-label sellers on Amazon are legally classified as manufacturers, even when production is outsourced. This responsibility cannot be contractually transferred to the supplier.
What you need to do
As manufacturer, take responsibility for the entire conformity assessment: risk assessment, testing, technical documentation, Declaration of Conformity, and CE marking.
