Compliance Checklist

CE Marking
Home & Kitchen
United Kingdom ๐Ÿ‡ฌ๐Ÿ‡ง

Complete compliance checklist for UKCA and CE marking of Home & Kitchen products on Amazon.co.uk โ€” including Electrical Equipment (Safety) Regulations 2016, EMC Regulations 2016, and Gas Appliances Regulation in post-Brexit United Kingdom.

Overview

Since Brexit, the United Kingdom has introduced the UKCA (UK Conformity Assessed) mark to replace CE marking for the GB market. For Home & Kitchen products โ€” particularly electrical appliances, electronic kitchen devices, and gas appliances โ€” the Electrical Equipment (Safety) Regulations 2016 (UK transposition of the Low Voltage Directive), the Electromagnetic Compatibility Regulations 2016 (EMC), and the Gas Appliances (Enforcement) and Miscellaneous Amendments Regulations 2018 apply. CE marking is accepted on a transitional basis until 31 December 2027. From 1 January 2028 onwards, only the UKCA mark will be accepted for the GB market (England, Scotland, Wales). Northern Ireland continues under the Windsor Framework and accepts CE marking. The Office for Product Safety and Standards (OPSS) is the primary enforcement authority, while local Trading Standards officers conduct market surveillance. Amazon.co.uk requires CE/UKCA conformity evidence, a UK Declaration of Conformity, and UK Responsible Person details for electrical products.

Does this apply to my product?

This checklist applies to all Home & Kitchen products sold on the GB market (England, Scotland, Wales), specifically: electrical kitchen appliances (toasters, kettles, blenders, coffee machines), electrical household appliances (vacuum cleaners, irons, fan heaters), electronic devices operating on mains voltage (50-1000V AC / 75-1500V DC), gas appliances and fittings for domestic use, and lighting and light sources. Excluded are purely mechanical products without electrical components, products below 50V AC / 75V DC (outside LVD scope), medical devices (separate regulation), and products exclusively for the Northern Ireland market (Windsor Framework, CE sufficient).

Step-by-Step Guide

1

Identify Regulatory Requirements

Determine which UK regulations apply to your Home & Kitchen product and identify the relevant Designated Standards (UK equivalents of harmonised standards).

Estimated time: 1-2 weeks

2

Product Testing and Conformity Assessment

Have your product tested against the relevant UK Designated Standards and carry out the conformity assessment procedure in accordance with UK regulations.

Estimated time: 4-8 weeks

3

Prepare Technical Documentation and UK Declaration of Conformity

Prepare the complete technical documentation and the UK Declaration of Conformity (UK DoC) in accordance with the requirements of UK regulations.

Estimated time: 2-3 weeks

4

Estimated time: ongoing

Common Mistakes to Avoid

Using the EU Declaration of Conformity instead of a separate UK Declaration of Conformity

Consequence: The EU DoC has no legal effect in the United Kingdom. OPSS and Trading Standards can order corrective actions, require product withdrawal, and impose fines of up to GBP 10,000 per offence. Amazon.co.uk may suspend listings.

Prevention: Always create a separate UK DoC that specifically references UK regulations (not EU Directives) and UK Designated Standards (not harmonised standards).

No UK Responsible Person appointed despite manufacturer being based outside the UK

Consequence: Without a UK RP, placing products on the GB market is unlawful. OPSS can prohibit sales. Amazon.co.uk increasingly requires proof of a UK RP for electrical products and suspends listings without this information.

Prevention: Before the first sale on Amazon.co.uk, appoint a UK Responsible Person based in the United Kingdom and provide their contact details on the product/packaging and in the Amazon listing.

Selling products with EU plugs (Type C/F) without a UK adapter or UK plug (BS 1363)

Consequence: Selling electrical appliances with non-UK plugs without a suitable adapter violates the Plugs and Sockets etc. (Safety) Regulations 1994. Trading Standards may seize products. Customers leave negative reviews, leading to account issues on Amazon.

Prevention: Equip all electrical products for the GB market with a BS 1363-compliant UK plug (Type G), either pre-fitted or as an included, dedicated adapter.

Assuming EU test reports from Notified Bodies automatically qualify for UKCA marking

Consequence: After the transition period ends (31 December 2027), EU Notified Body certificates will no longer be accepted for UKCA marking. Products without valid UK conformity evidence will need to be withdrawn from the market.

Prevention: Plan the transition to UK Approved Bodies early. During the transition period, EU reports can be used, but switch to UK-recognised testing in good time.

User instructions provided only in German or other EU languages, without an English version

Consequence: English-language instructions are legally required for the GB market. Missing English instructions lead to enforcement action by Trading Standards and negative Amazon customer reviews. Amazon may suspend listings.

Prevention: Ensure every product for Amazon.co.uk includes a complete English user manual, including UK-specific safety instructions.

Frequently Asked Questions

Q1Can I still use CE marking for the UK market after Brexit?

Yes, on a transitional basis until 31 December 2027. During this period, the GB market (England, Scotland, Wales) accepts both CE and UKCA marking for products that meet the underlying UK regulations. Northern Ireland continues under the Windsor Framework โ€” CE marking remains permanently sufficient there. From 1 January 2028, only UKCA marking will be accepted for new products placed on the GB market.

Q2What is the difference between a UK Approved Body and an EU Notified Body?

UK Approved Bodies are conformity assessment bodies designated by the Secretary of State for the United Kingdom, listed on gov.uk. They replace EU Notified Bodies for the GB market. Certificates from EU Notified Bodies will no longer be accepted for UKCA marking after the transition period ends (31 December 2027). Some organisations hold both UK Approved Body and EU Notified Body status, but the certificates are legally separate.

Q3Do I need a UK Responsible Person if I sell on Amazon.co.uk from the EU?

Yes, it is mandatory. If the manufacturer or importer is not established in the United Kingdom, a UK Responsible Person based in the UK must be appointed. The UK RP assumes regulatory duties towards OPSS and Trading Standards and must be identified by name and address on the product or packaging. Without a UK RP, products may not be placed on the GB market. SpaceGoats offers this service for Amazon sellers wishing to sell on Amazon.co.uk from the EU or third countries.

Q4What penalties apply for non-compliance with UK product safety regulations?

OPSS and Trading Standards have extensive enforcement powers: Compliance Notices (requiring corrective action), Withdrawal Notices (removal from market), Recall Notices (recall from consumers), fines up to GBP 10,000 per offence on summary conviction, unlimited fines on conviction on indictment, imprisonment up to 12 months for serious offences. Amazon.co.uk additionally takes its own actions including ASIN suspensions, account suspensions, and permanent seller bans.

Q5Must kitchen appliances be supplied with a UK plug (BS 1363)?

Yes, under the Plugs and Sockets etc. (Safety) Regulations 1994, all electrical household appliances sold in the United Kingdom must be fitted with a BS 1363-compliant UK plug (Type G, three-pin with fuse). This can be achieved through a pre-fitted UK plug or an included, dedicated adapter. The UK plug must contain an appropriate fuse (typically 3A or 13A). Loose universal travel adapters do not meet the requirements.

Q6Does UKCA marking apply to Northern Ireland?

No. Northern Ireland is subject to the Windsor Framework (formerly Northern Ireland Protocol) and continues to follow EU product safety rules. CE marking is required and sufficient for the Northern Ireland market. UKCA marking alone is not sufficient for Northern Ireland. Where a UK Approved Body is involved in conformity assessment, the UKNI mark is used alongside the CE mark. Sellers serving both the GB and NI markets need a dual strategy (UKCA for GB + CE for NI).
