Compliance Checklist

GPSR (General Product Safety Regulation)
Clothing & Fashion
United Kingdom ๐Ÿ‡ฌ๐Ÿ‡ง

Complete product safety checklist for clothing and textiles on Amazon UK. General Product Safety Regulations 2005, Textile Products Regulations 2012, UK Responsible Person, children's clothing safety and UK REACH requirements post-Brexit.

Overview

In the United Kingdom, clothing is subject to a standalone product safety framework separated from EU law since Brexit. The General Product Safety Regulations 2005 (SI 2005/1803) form the general safety net โ€“ the UK has not adopted the EU GPSR (Regulation 2023/988). The Textile Products (Labelling and Fibre Composition) Regulations 2012 require fibre composition labelling in English. Children's clothing is subject to special requirements: BS EN 14682 governs cords and drawstrings, the Nightwear (Safety) Regulations 1985 address nightwear flammability. UK REACH (independent of EU REACH) restricts chemical substances in textiles. The Office for Product Safety and Standards (OPSS) is the primary enforcement body, while local Trading Standards handle on-the-ground inspections. Non-UK manufacturers need a UK Responsible Person. The Product Safety and Metrology Bill will expand OPSS powers in the future. Northern Ireland partially continues to follow EU rules under the Windsor Framework.

Does this apply to my product?

This checklist applies to all sellers of clothing and textiles on Amazon.co.uk: outerwear, underwear, nightwear, sportswear, children's clothing of all age groups, babywear, accessories (scarves, hats, gloves, socks), swimwear, workwear and textile accessories. Special attention is required for children's clothing (cords per BS EN 14682), nightwear (flammability), clothing with small parts and textiles with skin contact (chemical safety under UK REACH).

Step-by-Step Guide

Progress0/15 (0%)
1

Determine regulatory role and appoint UK Responsible Person

Determine your regulatory role under the General Product Safety Regulations 2005 and appoint a UK Responsible Person based in Great Britain if required.

Estimated time: 1-2 weeks

2

Ensure textile labelling per UK regulations

The Textile Products (Labelling and Fibre Composition) Regulations 2012 mandate fibre composition labelling in English. This is the core regulatory requirement for clothing in the UK.

Estimated time: 1-2 weeks

3

Verify chemical safety and UK REACH compliance

UK REACH (independent of EU REACH since 1 January 2021) restricts certain chemical substances in textiles. The Health and Safety Executive (HSE) is the competent authority.

Estimated time: 1-3 weeks

4

Verify children's clothing safety and flammability

Children's clothing and nightwear are subject to particularly strict safety requirements in the UK. Cords on children's clothing are one of the most common causes of product recalls.

Estimated time: 1-2 weeks

5

Prepare risk assessment and technical documentation

The General Product Safety Regulations 2005 require manufacturers and importers to place only safe products on the market and demonstrate this through documentation.

Estimated time: 1-2 weeks

6

Meet Amazon.co.uk compliance requirements

Amazon.co.uk has its own compliance requirements for clothing. Ensure your listing meets all platform requirements.

Estimated time: 2-5 days

Common Mistakes to Avoid

Fibre composition not in English or using incorrect fibre designations

Consequence: Violation of the Textile Products Regulations 2012. Trading Standards can remove products and impose fines. Amazon.co.uk can suspend listings.

Prevention: Use exclusively the English fibre designations defined in the Regulations. Have fibre composition verified by a laboratory.

EU Responsible Person considered sufficient for the UK market

Consequence: Since Brexit, an EU Responsible Person is no longer valid for the GB market. OPSS can prohibit sales and have products seized.

Prevention: Appoint a separate UK Responsible Person based in Great Britain. This can be the same service provider but must have a UK address.

Cords and drawstrings on children's clothing not checked per BS EN 14682

Consequence: Most common cause of product recalls in UK clothing. Non-compliant products are immediately removed and Amazon permanently blocks the ASIN.

Prevention: Systematically check every children's clothing item (ages 0-14) for cords, drawstrings and loops. When in doubt: no cords in the neck and hood area.

UK REACH restrictions equated with EU REACH

Consequence: UK REACH and EU REACH are separate regimes since 1 January 2021. Limit values may differ. The HSE can impose fines and sales prohibitions.

Prevention: Always check the current UK REACH Annex XVII separately. Have test reports evaluated against UK REACH limits.

Nightwear flammability requirements ignored or only EU standards applied

Consequence: The Nightwear (Safety) Regulations 1985 are UK-specific and stricter than EU requirements. Trading Standards can pursue criminal prosecution โ€“ this is a criminal offence.

Prevention: Have all nightwear specifically tested per BS 5438/BS 5722. Do not rely on EU flammability testing alone.

Frequently Asked Questions

Q1Do I need UKCA marking for clothing in the UK?

No. Clothing and textiles do not fall under any EU directive requiring CE marking, and therefore are not subject to UKCA requirements. Clothing is instead subject to the General Product Safety Regulations 2005 and the Textile Products Regulations 2012.

Q2My product is EU-compliant โ€“ can I automatically sell it in the UK?

Not automatically. Since Brexit, EU and UK regulations are separate. You need: a UK Responsible Person, fibre labelling in English per UK Regulations, testing against UK REACH (not EU REACH), and for nightwear UK-specific flammability testing per Nightwear Regulations 1985.

Q3What happens if Trading Standards find issues?

Trading Standards can: require market removal (Withdrawal Notice), order recalls (Recall Notice), impose fines, and for serious violations pursue criminal prosecution. Amazon.co.uk is informed and suspends affected ASINs. Recall costs far exceed compliance costs.

Q4Does this checklist also apply to Northern Ireland?

Partially. Under the Windsor Framework, Northern Ireland partially follows EU rules for goods. For clothing sold only in Northern Ireland, EU compliance may suffice. For Great Britain (England, Wales, Scotland), UK regulations in this checklist apply. Selling in both requires compliance with both regimes.

Q5How can SpaceGoats help with UK clothing compliance?

SpaceGoats offers comprehensive UK compliance service for clothing sellers: acting as UK Responsible Person with UK address, textile labelling review, coordination of laboratory testing (UK REACH, flammability), preparation of technical documentation and risk assessment, Amazon.co.uk Seller Central setup and compliance attribute management.

Q6What changes does the Product Safety and Metrology Bill bring?

The Product Safety and Metrology Bill (PSMB) aims to give OPSS expanded powers: online marketplaces face greater obligations, recalls can be enforced faster, and the government gains flexibility to update product safety rules more quickly. For clothing sellers, this potentially means stricter enforcement.
