UKCA and CE marking for toys on Amazon UK: UK Toy Safety Regulations 2011, post-Brexit transition, UK Responsible Person and common mistakes.

Overview

Toys are one of the most heavily regulated product categories on Amazon.co.uk. The UK Toys (Safety) Regulations 2011 (SI 2011/1881) form the core legislation and mirror the EU Toy Safety Directive 2009/48/EC. After Brexit, UKCA marking will ultimately replace CE marking, though CE-marked toys continue to be accepted until October 2027. Age ratings, warnings in English and the appointment of a UK Responsible Person are mandatory. Amazon.co.uk monitors the toy category particularly strictly and may immediately suppress listings without complete compliance documents.

Does this apply to my product?

This checklist applies to all toys sold on Amazon.co.uk: soft toys, dolls, board games, construction toys, remote-controlled vehicles, educational toys, outdoor toys, bath toys, wooden toys and electronic toys. Excluded are, among others, adult collectibles (clearly labelled), sports equipment and decorative items – however, the distinction is narrow and must be carefully assessed.

Step-by-Step Guide

Progress0/11 (0%)
1

Assess applicability of UK Toy Safety Regulations

Determine whether your product qualifies as a toy under the UK Toys (Safety) Regulations 2011 and which specific requirements apply to your product type.

Estimated time: 1-2 days

2

Conduct safety testing to UK standards

Have your toy tested by an accredited laboratory to the relevant BS EN 71 standards. These tests cover mechanical, physical, chemical and electrical safety.

Estimated time: 3-6 weeks

3

Appoint UK Responsible Person and prepare marking

Appoint a UK Responsible Person and prepare the correct product labelling with warnings in English.

Estimated time: 1-2 weeks

4

Prepare technical documentation and UK DoC

Prepare the complete technical documentation and UK Declaration of Conformity for your toy.

Estimated time: 1-2 weeks

5

Create Amazon.co.uk listing and demonstrate compliance

Meet Amazon's specific requirements for toy listings on Amazon.co.uk.

Estimated time: 2-5 days

Common Mistakes to Avoid

Warnings only in German or Chinese language on packaging

Consequence: Toys without English-language warnings may not be sold in the UK. Amazon removes such listings immediately and Trading Standards can impose fines.

Prevention: Ensure all warnings, age ratings and instructions for use are in English on the packaging – ideally as the primary language, not just as a sticker.

Test reports from non-accredited laboratories submitted

Consequence: Amazon and UK market surveillance only accept test reports from accredited laboratories (ideally UKAS or ISO 17025). Non-accredited reports lead to listing suspensions and retesting costs.

Prevention: Only commission UKAS-accredited or ISO 17025-accredited testing laboratories. Verify accreditation before placing the order.

Age rating set incorrectly to target a larger audience

Consequence: An age rating set too high (e.g. 'ages 6+' when the product is attractive to younger children) can be considered circumvention of safety requirements. In case of injury, criminal consequences and product liability may follow.

Prevention: Set the age rating conservatively and honestly. Consider foreseeable use – not just intended use. Toys for under 3 years face the strictest requirements.

No batch or serial number applied to the toy

Consequence: Without traceability marking, a targeted recall is impossible. UK authorities may remove the entire product line from the market instead of just the affected batch.

Prevention: Apply a batch or serial number to every toy. Maintain a traceability system documenting production, testing and shipping.

Frequently Asked Questions

Q1Is my EU toy safety testing sufficient for the UK market?

During the transition period until October 2027, CE-compliant testing is accepted. However, test reports must come from an accredited laboratory. For standalone UKCA marking, reports should reference BS EN 71 and come from a UKAS-accredited laboratory.

Q2How strictly does Amazon.co.uk monitor toy listings?

Very strictly. Toys are one of the most closely monitored categories. Amazon regularly requests test reports, UK DoC and packaging photos. Listings are frequently suspended without warning if documents are missing or incomplete.

Q3My toy contains magnets – do special rules apply?

Yes. Magnetic toys are subject to tightened requirements. Magnets must be attached so they cannot be removed by children, and flux density must be below certain limits. Special warnings ('Warning: contains small magnets') are mandatory.

Q4Do I also need a UK Responsible Person for toys?

Yes, absolutely. For all toys sold on the UK market by non-UK manufacturers, a UK Responsible Person with a UK address is mandatory. They must be named on the product or packaging.

Q5What if UK limit values differ from EU limit values in the future?

This is a real risk after Brexit. The UK government can independently change limit values for chemical substances in toys. Stay informed about changes on the OPSS website and plan separate testing for UK and EU if necessary.
