GPSR compliance for furniture on Amazon.es: obligations under Regulation (EU) 2023/988, Spanish enforcement through the Comunidades Autonomas, UNE standards and Spanish-language labelling.

Overview

The General Product Safety Regulation (GPSR), Regulation (EU) 2023/988, has been in force since December 13, 2024 and is the central safety framework for furniture on Amazon.es, since there is no dedicated EU furniture directive. Under Art. 23 GPSR, Spain set up its own Oficina de Enlace Unica de Seguridad General de los Productos (OEU SGP), housed in the Direccion General de Consumo at the Ministerio de Derechos Sociales, Consumo y Agenda 2030. It coordinates GPSR market surveillance nationally and represents Spain on the EU committee, but actual enforcement (inspections, recalls, fines) sits decentrally with the 17 Comunidades Autonomas. Harmonised EN furniture standards are adopted in Spain as identical UNE-EN standards (e.g. UNE-EN 14749, UNE-EN 16139), drafted by technical committee AEN/CTN 56 (wood and cork) resp. CTN 11 (furniture) at AENOR.

Does this apply to my product?

The GPSR applies to all furniture and furnishing items sold to consumers on Amazon.es: shelves, cabinets, tables, chairs, beds, dressers, TV units, coffee tables, desks, outdoor furniture pieces and flat-pack furniture. Exceptions include antiques and products falling under sector-specific EU harmonisation legislation with their own safety requirements.

Step-by-Step Guide

Progress0/14 (0%)
1

Determine your role as economic operator and derive obligations

The GPSR defines different obligations depending on your role in the supply chain. Correctly identifying your role is the first step towards compliance.

Estimated time: 1-2 Tage

2

Conduct risk assessment and check UNE standards

The GPSR requires an internal risk analysis of furniture-typical hazards. In Spain, the EU standards apply as identical UNE-EN standards.

Estimated time: 3-7 Tage

3

Ensure technical documentation and traceability

The GPSR requires complete traceability and technical documentation that must be presented to Spanish authorities on request.

Estimated time: 3-5 Tage

4

Apply Spanish-language labelling and consumer information

In addition to the GPSR mandatory information, general Spanish labelling law requires consumer information to be easily understandable in Spanish.

Estimated time: 2-4 Tage

5

Set up reporting obligations and account for Spanish enforcement structure

The GPSR obliges reporting of safety defects. In Spain, coordination runs through the OEU SGP, but actual enforcement is decentralised through the Comunidades Autonomas.

Estimated time: 1-3 Tage

6

Complete Amazon listing with GPSR mandatory fields

Since December 2024, Amazon requires GPSR mandatory information in Seller Central. Without correct details, listing suspension on Amazon.es is possible.

Estimated time: 1-2 Tage

Common Mistakes to Avoid

No Responsible Person in the EU designated for third-country manufacturers

Consequence: Without a Responsible Person per Art. 16 GPSR, the furniture product may not be sold on Amazon.es since December 2024. Amazon can suspend the listing, and the responsible Comunidad Autonoma can impose fines under the TRLGDCU.

Prevention: Designate a Responsible Person based in the EU before starting sales.

Assembly instructions only in English or Chinese included

Consequence: Violation of Real Decreto 1468/1988 on labelling of industrial products. Customers may assemble furniture incorrectly, leading to safety risks, increased returns and negative reviews.

Prevention: Ensure assembly instructions and safety warnings are available in Spanish, ideally with language-independent drawings.

Ignoring tip-over protection for shelves and cabinets

Consequence: Tipping furniture is one of the most common causes of household accidents, especially involving children. Missing tip-over protection can lead to recalls, liability claims and fines from the responsible Comunidad Autonoma.

Prevention: Include a wall anchoring kit with every cabinet and shelf over 60 cm. Test tip-over safety according to UNE-EN 14749.

Wrong expectation of a single central Spanish oversight authority

Consequence: Sellers often assume that contact with the OEU SGP in Madrid is sufficient. In reality, the Comunidad Autonoma responsible for the distributor's or importer's location carries out inspections, recalls and fine proceedings - contacting the wrong body delays the response to complaints.

Prevention: Clarify in advance which Comunidad Autonoma is responsible for your location or warehouse, and keep their contact details on hand.

Frequently Asked Questions

Q1Do furniture products need CE marking in Spain?

No. Since there is no specific EU directive for furniture that requires CE marking, furniture products must not bear a CE mark - it would even be misleading. Furniture safety is instead regulated via the GPSR, which does not provide for CE marking.

Q2Who specifically oversees GPSR for furniture in Spain?

The OEU SGP at the Direccion General de Consumo (Ministerio de Derechos Sociales, Consumo y Agenda 2030) is the national coordination point under Art. 23 GPSR and the contact for the EU level. Operational market surveillance - inspections, recalls, fine proceedings - is decentralised to the 17 Comunidades Autonomas.

Q3What happens if I don't fill in the GPSR mandatory fields as an Amazon seller?

Amazon can suspend your listing or restrict your seller account. Since December 2024, Amazon enforces the provision of manufacturer data, Responsible Person and contact information. Additionally, the responsible Comunidad Autonoma can prohibit sales and impose fines under the TRLGDCU.

Q4Which harmful substances are particularly relevant for furniture?

Formaldehyde is the most common problematic substance - found in chipboard, MDF, adhesives and paints. The REACH Regulation (Annex XVII No. 72) limits formaldehyde content EU-wide, directly applicable in Spain too. Other relevant substances: heavy metals in paints, plasticisers in faux leather. Particularly strict limits apply to children's furniture.

Q5Do I need to follow UNE standards in addition to EN standards?

No, not additionally - UNE-EN standards are the verbatim Spanish adoption of the European EN standards (e.g. UNE-EN 14749 = EN 14749), drafted and published by AENOR. Complying with an EN standard automatically satisfies the UNE-EN version too - it is the same technical standard, just with a Spanish designation and, where available, a Spanish-language edition.
