Common Mistakes to Avoid
Machinery Directive ignored – only LVD and EMC tested
Consequence: Incomplete CE marking. The Machinery Directive is the central directive for power tools – without it the DoC is invalid. Market surveillance authorities can prohibit sales immediately.
Prevention: Always check first whether your product falls under the Machinery Directive 2006/42/EC. All power tools with a motor or drive are machines within the meaning of the directive. Risk assessment according to EN ISO 12100 is mandatory.
No risk assessment according to EN ISO 12100 performed
Consequence: The risk assessment is a mandatory requirement of the Machinery Directive. Without it, the entire CE marking is invalid – even if tests were passed. In case of accidents, personal liability of the person placing on the market is possible.
Prevention: Create the risk assessment BEFORE testing begins. Systematically identify all hazards and document risk reduction measures. Use EN ISO 12100 as a guide.
Vibration and noise values not stated in operating instructions
Consequence: Violation of the Machinery Directive and EN 62841. Declaration of hand-arm vibration values and sound power level is mandatory for power tools. Missing information leads to complaints from market surveillance.
Prevention: Have vibration and noise measurements carried out according to the relevant standards. State both the declared values and measurement uncertainty in the operating instructions. Values must be measured product-specifically – do not use generic values.
CE mark adopted from Chinese supplier without verification
Consequence: As an importer, YOU are responsible – not the supplier. Chinese CE marks for tools are often based on insufficient test reports and missing risk assessments. Inspections can result in fines up to 100,000 EUR and product recall.
Prevention: Request complete technical documentation including risk assessment, DoC and test reports from the supplier. Have critical safety tests according to EN 62841 repeated in an EU-accredited laboratory.
No German operating instructions with all mandatory information
Consequence: Violation of the Machinery Directive and the ProdSG. Without complete operating instructions in the national language, the tool may not be sold. Amazon customers complain, negative reviews are likely.
Prevention: Create comprehensive operating instructions in German with: safety instructions, intended use, residual risks, vibration/noise values, maintenance, spare parts and disposal. Follow EN 62841 and the Machinery Directive Annex I.
Frequently Asked Questions
Yes, absolutely. Even though battery tools under 50V are exempt from the Low Voltage Directive, they fully fall under the Machinery Directive 2006/42/EC and the EMC Directive 2014/30/EU. CE marking is therefore mandatory in any case – risk assessment and safety tests according to EN 62841 must be carried out.
Annex IV of the Machinery Directive lists particularly dangerous machines for which type examination by a Notified Body is required. These include hand-held circular saws, chainsaws and certain woodworking machines. For most Amazon-typical power tools like cordless drills, jigsaws and grinders, no Notified Body is needed – internal production control (Module A) is sufficient.

No, not directly. If you sell a tool under your own brand, you are considered the manufacturer within the meaning of the Machinery Directive. You must issue your own Declaration of Conformity in your company name. The supplier's test reports can serve as a basis, but the DoC, risk assessment and operating instructions must be issued in your name as manufacturer.
